Library Rules

Hours
1.  (a) The Library shall be open between the hours of 8.30 am. and 5 pm. Monday to Friday but excluding statutory holidays and such other times as the Council may decide.
(b) Authorised persons holding an access card may use the Library at any other time.
Right of Admission
The following persons shall have a right of access to the Library:
2. (a) Members of the Wellington District Law Society including honorary members, honorary life associates, and associate members, provided that associate members shall have no right of access or use under this rule unless they have paid an annual Library Use Subscription as set from time to time by the Council, provided further that the Council may exempt an associate member for payment of such subscription in whole or in part; 
(b) other legal practitioners holding a current practising certificate in New Zealand or Australia; 
(c) Judges and Masters of the Courts and Tribunals of New Zealand and the Federal and High Courts of Australia;
(d) The Attorney-General and Solicitor-General;
(e) Registrars and Deputy Registrars of the Courts and Tribunals of New Zealand.
3. Other persons, including members of the Law Faculty, law students, law clerks, legal executives and librarians, may use the library with the consent of the Librarian, provided that;
(a) In the case of doubt, the Librarian may refer an application by such person to the Library Committee or the Council for approval;
(b) In granting permission the Council or the Library Committee may restrict the use of the Library to such days and hours and in such manner as may from time to time be deemed expedient;
(c)  The Council or the Library Committee may at any time withdraw any permission granted under this Rule.
(d) If the Librarian considers that any person using the Library under this rule 3 has acted or is likely to act in a manner which would be a breach of these Bylaws if done by a member, the Librarian is empowered to withdraw consent to use with 
immediate effect, and to prohibit further use of the Library by such person for any period up to two (2) months.
(e) The Librarian may with the consent of the Council or the Library Committee 
(i)  Impose conditions of use on the persons having access to the Library under this rule.
(ii) . Require such persons to enter into a form of agreement whereunder they agree to observe such conditions, these Bylaws as if they were a member, and such provisions as are considered appropriate
(iii) Impose payment of a deposit as a bond for performance of any such agreement.
Use of Library Materials 
4. Books may be taken by practitioners and the judiciary to the Court of Appeal, the High 
Court and the District Court at Wellington and such persons shall be responsible for 
ensuring that all books are returned promptly after use in such Court.
5. Books may be taken by persons practitioners and the judiciary for use in any other 
Court or Tribunal with the permission of the Librarian, and such persons shall be 
responsible for ensuring that all books are returned promptly after use in such Court or 
Tribunal.
6. Except as provided by these Bylaws no books shall be taken out of the Library by any 
person upon any excuse whatsoever.
7.  The librarian shall have the discretion to lend books to other libraries for reasonable 
periods on such terms as he or she reasonably considers appropriate.
8.  Pages in books must not be turned down, marked or in any way defaced or damaged.  
After use, books must not be left lying open. Databases, computers and electronic 
materials of the library must not be damaged or misused. 
9 . All provisions of the Copyright Act must be observed.
General 
10. No talking shall be permitted when it interrupts or disturbs persons reading or studying.
11. No smoking is permitted in the Library.
12. Pay telephones are provided for the exclusive and reasonable use of those authorised to use the Library.
13. No person authorised to use the Library shall bring or invite into the Library any persons not qualified to use the Library under these rules.
14.  The Notice board in the Library may be used for posting such Rules and information as may be authorised by the Librarian or Executive Director.
15. Persons permitted to use the Library shall ensure that when leaving the Library after the hours specified in rule 1(a)
. (a) the outer door of the Library is securely locked;
. (b) all lights are switched off.
Library Access Cards
16. Every person who is entitled to use the Library under rule 2 or otherwise authorised by Council may obtain from the Librarian an access card to the Library street entrance door, subject to payment of such charges as may be fixed by the Council, and any costs 
incurred by the Library in issuing the card.
17. A Library access card shall not be lent by the holder without special permission of the Librarian.
18. Any practitioner visiting Wellington wishing to use the Library may obtain an access card from the Librarian, and it shall be returned before he or she leaves the city.
19.  No holder of any access card is allowed to have any duplicate made.
20. Any person losing his or her access card must report the loss the Librarian forthwith. A replacement may be obtained from the Librarian on payment of the cost thereof.
21. Any person who ceases to be entitled to hold an access card under these Bylaws shall deliver up his or her access card to the Librarian.
22. The Council shall have the power, in the case of a willful breach of any of the Bylaws relating to access cards, to demand the access card held by the offender and no access card shall thereafter be issued to him or her except at the discretion of the Council.
Robing Room
23. Lockers in any library or room in the control of the Society shall be allotted to practitioners by the Librarian subject to the following conditions:
. (a) The rent, as determined by the Council, shall be paid in advance on the 31 January each year;
. (b) Any locker, the rent of which is three months in arrears and which is not paid on demand being made by the Executive Director, shall be vacated and may be allotted by the Librarian to any other applicant;
. (c) Every occupier shall be responsible for the keys to his or her locker, and shall make good any losses;
. (d)  After use gowns and wig boxes shall be replaced in lockers;
. (e) The Librarian may at his or her discretion, if circumstances require, take over and reallocate any locker.
Breaches of Bylaws
24. The Librarian shall report any serious or repeated breach of these Bylaws to the Library Committee or the Executive Director. Either may report such breach to the Council for review and consideration whether a penalty should be imposed or other action taken.
25. Any person using the Library books, databases, other equipment or facilities shall forthwith upon the request by the Librarian pay such compensation for the loss, damage or destruction to the same caused by such use. Compensation shall extend to the cost of 
replacement by a new copy of the book or software damaged, or the cost of a complete set of books or software suite if the book lost or damaged is part of a set or if the software item is part of a suite and the book or item cannot readily be replaced individually. Any person who has responsibility for a book removed from the Library shall be liable to pay compensation even if loss or damage has not been caused by him or her personally.
26. The Council may order any person who commits a breach of these Bylaws(other than 
not non-intentional damage or loss to books or electronic media) to pay a fine not 
exceeding $500.00. The Council may additionally in respect of such breach make an 
order for payment of compensation in respect of the damage or destruction of property 
to the same extent as provided in rule 24.
27. Any person fined by the Council or directed to pay compensation for damage done, shall not be permitted to use the Library until the amount due by him or her is paid.
